Flux devは商用利用できない、というのがまことしやかに、半ば常識のように囁かれている。
私もずっとそう信じてきたのだが、どうもそうでもない可能性があるらしい。

The real question is, are we actually going to see large-scale high-quality fine-tunes of flux? It takes a lot of money to finetune it. If you have to pay BFL for it’s use commecially, then dish out a few thousand dollars for GPU rental fees, I wonder how many actually good full finetunes we’ll end up seeing on civitai over the next few months. My guess is, not many.

案の定聖書の解釈戦争のごとく論争になっていてワロタ。worst lisence ever.
しかし、上記Redditの発言や、
IIRC BFL has stated on discord that except as expressly prohibited herein refers to “You may not use the Output to train, fine-tune or distill a model that is competitive with the FLUX.1 [dev] Model”.Otherwise, the “(including for commercial purposes)” part makes no sense at all.
という記述(これは前述Redditの定義とマッチする)をあわせて考えるに、これらが真実なのであれば、やはりマージモデルや派生品ではない純正Flux devからの生成結果は商用利用可能ということになる。
これが解釈1としよう。より保守的な解釈としては、「as expressly prohibited herein」は「you do not receive any direct or indirect payment** arising from the use of the model or its output」の部分を指し、「You may use Output for any purpose」はBFLに直接コンタクトをとって商用ライセンスを獲得した者のみ、という解釈がある。これが解釈2。

個人的にもっともprobableな解釈としては、BFLという決して巨大とは言えない開発者グループの自己防衛のための楯ではないかと思う。これだけわかりにくいライセンスを敷いているのも、いわゆる「二次創作は全部違法だけど黙認してやるよ~、だから許可取りにきたりしないでね!ダメって言うしか無いから!」という現状世界と似た構図ではないか。私はなんの責任も請け負いません、という回りくどい言い方ではないか。

もっとセーフにいくなら、Schnellはこんな回りくどいライセンスじゃなくてapache2だからどう使おうが真っ白ってくらいですかね。
